Litigation Attorney

A Litigation Attorney is responsible for developing case strategies by conducting thorough investigations to gather facts, evidence, and relevant case law. They create and file pleadings, including complaints, answers, counterclaims, and motions, to shape the course of litigation. A significant part of their duties involves managing the discovery process, which includes drafting and responding to interrogatories, requests for production of documents, and subpoenas. They also conduct depositions and interviews with witnesses and experts to build a strong case, ensuring compliance with procedural rules and deadlines. Throughout the pre-trial stage, they prepare and argue various motions to dismiss, summary judgments, and other procedural defenses to advance their client's position.

In the trial phase, Litigation Attorneys meticulously prepare for courtroom appearances by organizing evidence, preparing witnesses, and drafting persuasive opening and closing statements. They present arguments, examine and cross-examine witnesses, and introduce evidence to support their client's claims or defenses. Their responsibilities continue post-trial as they navigate settlement negotiations or post-trial motions, and if necessary, pursue or defend appeals to higher courts. They also play a critical role in maintaining ongoing client communication, providing updates and strategic advice while managing client expectations. Through each step of the legal process, they aim to achieve favorable outcomes for their clients, while adhering to ethical standards and staying abreast of legal developments.

Becoming a Litigation Attorney typically requires a Juris Doctor (JD) degree from an accredited law school, where students acquire foundational knowledge in areas such as civil procedure, criminal law, torts, contracts, and constitutional law. To practice law, they must pass the bar examination in the jurisdiction where they intend to work. Gaining practical experience through internships or clerkships during law school is highly beneficial, offering insights into court procedures and case management. Additionally, obtaining certifications in specialized areas of litigation, such as civil trial law or criminal trial advocacy, can enhance expertise and career prospects. Continuing legal education (CLE) is essential to stay updated on new laws, legal precedents, and litigation techniques.
